<blockquote><p>TAMPA – No doubt you’ve heard the adage: <a href="http://www.dailypaul.com/196226/tampa-florida-police-torture-kill-ohio-man-with-pepper-spray">a picture is worth a thousand words.</a> A picture of 62-year-old Nick Christie could be worth thousands of dollars when a jury sees it.</p>
<p>The photo shows the Ohio man restrained inside the Lee County Jail with his body covered in pepper spray.</p>
<p>“This photo is a picture of a man who is strapped to a chair naked inside a jail for hours with a hood over his face. That evokes thoughts of being tortured,” says Cleveland-based lawyer Nick DiCello who represents the Christie family.</p>
<p>The photo, which was obtained by FOX 13′s investigative unit, was taken in the final hours of Christie’s life.</p>
<p>The District 21 Medical Examiner ruled his death was a homicide because he had been restrained and sprayed with pepper sprayed by law enforcement officers. But to this day, nobody has ever been charged with a crime, and the Lee County State Attorney cleared the sheriff’s office of any wrong doing.</p></blockquote>

<p><em>If you’re a Wall Street behemoth, there are endless opportunities to privatize profits and socialize losses beyond collecting trillions of dollars in bailouts from taxpayers. One of the ingenious methods that has remained below the public’s radar was started by the Rudy Giuliani administration in New York City in 1998. It’s called the Paid Detail Unit and it allows the New York Stock Exchange and Wall Street corporations, including those repeatedly charged with crimes, to order up a flank of New York’s finest with the ease of dialing the deli for a pastrami on rye.</em></p>
<p>The corporations pay an average of $37 an hour (no medical, no pension benefit, no overtime pay) for a member of the NYPD, with gun, handcuffs and the ability to arrest. <strong>The officer is indemnified by the taxpayer, not the corporation.</strong></p>
<p>New York City gets a 10 percent administrative fee on top of the $37 per hour paid to the police. The City’s 2011 budget called for $1,184,000 in Paid Detail fees, meaning private corporations were paying wages of $11.8 million to police participating in the Paid Detail Unit. The program has more than doubled in revenue to the city since 2002.</p>
<p><em>The taxpayer has paid for the training of the rent-a-cop, his uniform and gun, and will pick up the legal tab for lawsuits stemming from the police personnel following illegal instructions from its corporate master. Lawsuits have already sprung up from the program.</em><br />

The First Circuit Court of Appeals reached a crucial decision last Friday allowing the public to videotape police officers while they&#8217;re on the clock.</p>
<p>The decision comes after a string of incidents where individuals have videotaped police officers and were arrested. Police officers across the United States believed citizens didn&#8217;t have the right to videotape them as they conducted official duties, but issues like police brutality put the issue up for debate.</p>
<p>One instance where a citizen was arrested for videotaping an officer was when Khaliah Fitchette, a law-abiding teenager from New Jersey, boarded a bus in Newark. Two police officers boarded the bus as well to remove a drunken man. Fitchette began taping the police officers because of how they were handling the man, and a police officer instructed her to stop recording them. When <a href="http://www.dailytech.com/Law+Enforcement+Tape+Us+Go+to+Prison/article21633.htm">Fitchette refused, she was arrested</a> and placed in the back of a cop car for two hours while the officers took her phone to delete the video. Fitchette was then released, but she and her mother then filed suit against the Newark Police Department with the New Jersey chapter of the American Civil Liberties Union (ACLU).</p>
<p>Another example involves Simon Glik, a passerby on the Boston Common. He used his cell phone to tape police officers when the Boston police were punching a man. Citizens surrounding the scene were saying, &#8220;You&#8217;re hurting him.&#8221; Glik never interfered with the police officers&#8217; actions, but recorded the entire incident. The police officers ended up charging Glik with violating a wiretap statute that prohibits secret recording, even though the police officers admitted that they knew Glik was recording them. He was also charged with disturbing the peace and aiding the escape of a prisoner.</p>
<p>While all charges against Glik were dropped due to lack of merit, he still decided to join forces with the ACLU and file a civil rights suit to prevent a similar incident from occurring with others.</p>
<p>On Friday, August 26, 2011, the First Circuit Court of Appeals, which is New England&#8217;s highest federal court just below the U.S. Supreme Court, <a href="http://boston.com/community/blogs/on_liberty/2011/08/victory_for_liberty_and_the_ri.html">ruled that citizens are allowed to videotape law officials while they conduct official duties</a>.</p>
<p>The city&#8217;s attorneys made the argument that police officers should have been exempt from a civil rights lawsuit in the first place in this case because the law is unclear as to whether there&#8217;s a &#8220;constitutionally protected right to videotape police&#8221; conducting their daily duties in public.</p>
<p>&#8220;The filming of government officials engaged in their duties in a public place, including police officers performing their responsibilities, fits comfortably within these principles [of protected First Amendment activity].,&#8221; said the Court. &#8220;Gathering information about government officials in a form that can readily be disseminated to others serves a cardinal First Amendment interest in protecting and promoting the free discussion of governmental affairs.&#8221;</p>
<p>The Court added that the police officers should have understood this all along, and that <a href="http://www.dailytech.com/Chicago+Police+Tape+Us+Get+Sentenced+to+15+Years+in+Prison/article20735.htm">videotaping public officials</a> is not limited to the press.</p>
<p>&#8220;Moreover, changes in technology and society have made the lines between private citizen and journalist exceedingly difficult to draw,&#8221; the Court continued. &#8220;The proliferation of electronic devices with video-recording capability means that many of our images of current events come from bystanders with a ready cell phone or digital camera rather than a traditional film crew, and news stories are now just as likely to be <a href="http://www.dailytech.com/Bloggers+Protected+by+Court+Ruling+as+Journalists/article9491.htm">broken by a blogger</a> at her computer as a reporter at a major newspaper. Such developments make clear why the news-gathering protections of the First Amendment cannot turn on professional credentials or status.&#8221;</p>
<p>The Court concluded that police officers are to expect to deal with certain &#8220;burdens&#8221; as citizens practice First Amendment rights, but that there needs to be a healthy balance between police officers being videotaped while acting irresponsibly and the harassment of officers with recording devices while they&#8217;re conducting their duties responsibly.<br />

As journalist <a href="http://www.harpers.org/archive/2010/03/0082866">Ando Arike</a> puts it, &#8220;The result is what appears to be the first arms race in which the opponent is the general population.&#8221;</p>
<p>The demand for non-lethal weapons (NLW) is rooted in the rise of  television. In the 1960s and &#8217;70s the medium let everyday Americans  witness the violent tactics used to suppress the civil rights and  anti-war movements.</p>
<p>Today’s rapid advancements in media and telecommunications  technologies allow people to record and publicize images and video of  undue force more than ever before. Authorities are well aware of how  images of violence play out publicly. In 1997, a joint report from the <a href="https://www.ncjrs.gov/pdffiles/164268.pdf">Pentagon and the Justice Department</a> warned:</p>
<blockquote><p>&#8220;A further consideration that affects how the military and law  enforcement apply force is the greater presence of members of the media  or other civilians who are observing, if not recording, the situation.  Even the lawful application of force can be misrepresented to or  misunderstood by the public. More than ever, the police and the military  must be highly discreet when applying force.&#8221;</p></blockquote>
<p>The global economic collapse coupled with the unpredictable and  increasingly catastrophic consequences of climate change and resource  scarcity, along with a new era of austerity defined by rising  unemployment and glaring inequality have already led to massive protests  in Spain, Greece, Egypt, and even Madison, Wisconsin. From the  progressive era to the Great Depression to the civil rights movement,  Americans have a rich history of taking to the streets to demand greater  equality.</p>
<p>Meanwhile, tens of millions of dollars have been invested in the  research and development of more media-friendly weapons for everyday  policing and crowd control. This has lead to a trade-in of old  school weapons for more exotic and controversial technologies. The  following are six of the most outrageous &#8220;non-lethal&#8221; weapons that will  define the future of crowd control.</p>
<p>1. The Invisible Pain Ray: The &#8216;Holy Grail of Crowd Control&#8217;</p>

<p>It sounds like a weapon out of Star Wars. The <a href="http://en.wikipedia.org/wiki/Active_Denial_System">Active Denial System</a>,  or ADS, works like an open-air microwave oven, projecting a focused  beam of electromagnetic radiation to heat the skin of its targets to 130  degrees. This creates an intolerable burning sensation forcing those in  its path to instinctively flee (a response the Air Force dubs the &#8220;<a href="http://www.wired.com/science/discoveries/news/2006/12/72134?currentPage=2">goodbye effect</a>&#8220;).</p>
<p>The Pentagon&#8217;s <a href="http://jnlwp.defense.gov/">Joint Non-Lethal Weapons Program</a> (JNLWP) <a href="http://jnlwp.defense.gov/ads.html">says</a>,  &#8220;This capability will add to the ability to stop, deter and turn back  an advancing adversary, providing an alternative to lethal  force.&#8221; Although ADS is described as non-lethal, a 2008 <a href="http://www.bundesstiftung-friedensforschung.de/pdf-docs/berichtaltmann2.pdf">report</a> by physicist and less-lethal weapons expert Dr. Jürgen Altmann suggests otherwise:</p>
<p>&#8221; &#8230; the ADS provides the technical possibility to produce burns of  second and third degree. Because the beam of diameter 2 m and above is  wider than human size, such burns would occur over considerable parts of  the body, up to 50% of its surface. Second- and third-degree burns  covering more than 20% of the body surface are potentially  life-threatening – due to toxic tissue-decay products and increased  sensitivity to infection – and require intensive care in a specialized  unit. Without a technical device that reliably prevents re-triggering on  the same target subject, the ADS has a potential to produce permanent  injury or death. &#8221;</p>
<p>The weapon was initially <a href="http://www.aolnews.com/2010/06/17/us-may-unleash-microwave-weapon-in-afghanistan/">tested in Afghanistan</a>, but later <a href="http://www.engadget.com/2010/07/18/raytheons-pain-gun-finally-gets-deployed-in-afghanistan/">recalled</a> due to a combination of technical difficulties and political concerns, including the fear that ADS would be used as a <a href="http://www.wired.com/dangerroom/2007/08/no-pain-ray-for/">torture tool</a> making it &#8220;<a href="http://www.wired.com/dangerroom/2008/08/weve-heard-it-o/">not politically tenable</a>,&#8221;  according to a Defense Science Board report. The tens of millions of  dollars spent to develop the ADS did not necessarily go to waste,  however.</p>
<p>While the weapon may be too controversial for use on the battlefield,  it appears that nothing is too sadistic for use on US prisoners, so the  ADS has since been modified into a smaller version by Raytheon, for use  in law enforcement. Last year, the renamed Assault Intervention System  (AIS) was <a href="http://www.pasadenastarnews.com/ci_15844824">installed</a> at  the Pitchess Detention Center&#8217;s North County Correction Facility at the  behest of the Los Angeles County Sheriff’s Department (LASD). Former  LASD Commander, <a href="http://seattletimes.nwsource.com/html/nationworld/2003896377_gadgets22.html">Charles “Sid” Heal</a> had been lobbying for the pain ray for years, calling it the &#8220;<a href="http://raniakhalek.wordpress.com/wp-admin/Holy%20Grail%20of%20crowd%20control">Holy Grail of Crowd Control</a>,&#8221; due to its ability to make people scatter almost instantly.</p>
<p>The device is <a href="http://news.blogs.cnn.com/2010/08/24/l-a-jail-tests-intolerable-heat-beam-on-brawling-inmates/">operated</a> by a jail officer with a joystick, and is intended to break up prison riots, inmate brawls and prevent assaults on officers. <a href="http://articles.cnn.com/2010-08-31/justice/california.heat.ray_1_county-jail-inmates-fights-baca-last-week?_s=PM:CRIME">Sheriff Lee Baca</a> added that it would allow officers to quickly intervene without having to physically enter the area to incapacitate prisoners.</p>
<p>The ACLU <a href="http://www.rawstory.com/rs/2010/08/26/aclu-protests-torture-prisoners-pain-ray/">claims</a> that use of such a device on American prisoners is &#8220;tantamount to torture.&#8221; The organization even <a href="http://www.aclu.org/files/assets/Letter_to_Baca_8.26.10.pdf">sent a letter</a> to  the sheriff in charge, demanding he never use the energy weapon against  inmates. “The idea that a military weapon designed to cause intolerable  pain should be used against county jail inmates is staggeringly  wrongheaded,” <a href="http://www.aclu.org/prisoners-rights/aclu-calls-los-angeles-county-sheriff-s-officials-abandon-plans-use-military-heat-r">said</a> Margaret  Winter, associate director of the ACLU National Prison Project.  “Unnecessarily inflicting severe pain and taking such unnecessary risks  with people’s lives is a clear violation of the Eighth Amendment and due  process clause of the U.S. Constitution.”</p>
<p>The pain ray’s use in the Pitchess Detention Center is a pilot  program. If successful, the weapon could find its way into other prisons  around the country. The National Institute of Justice has also <a href="http://www.wired.com/politics/security/news/2007/12/pain_beam">expressed interest</a> in a hand-held, rifle-sized, short-range weapon that could be effective at tens of feet for law enforcement officials.</p>
<p>2. The Laser Blinding &#8216;Dazzler&#8217;</p>

<p>The <a href="http://www.wired.com/dangerroom/2010/10/best-military-prototypes/?pid=99">Personal Halting and Stimulation Response</a> rifle, or PHaSR, is a massive laser shooter. PHaSR technology is being <a href="http://www.nij.gov/topics/technology/less-lethal/laser.htm">co-funded</a> by the <a href="http://nij.gov/">National Institute of Justice</a> (NIJ), <a href="http://jnlwp.defense.gov/">Joint Non-Lethal Weapons Program</a> (JNLWP),  and the Office of the Secretary of Defense, and is being developed by  the Air Force Research Laboratory. While JNLWP is interested in the  technology for military applications, NIJ is focusing on its law  enforcement use.</p>
<p>So what is the purpose of this light-shooting toy? Well, it won&#8217;t  kill you, but it will temporarily blind you — or as the NIJ prefers to  say, it will &#8220;dazzle&#8221; you into disorientation — by shooting you with two  low­-power diode­-pumped lasers.</p>
<p><a href="http://www.icrc.org/customary-ihl/eng/docs/v1_rul_rule86">Protocol IV</a>,  the Blinding Laser Protocol of the United Nations Convention on  Conventional Weapons, states that, &#8221;The use of laser weapons that are  specifically designed, as their sole combat function or as one of their  combat functions, to cause permanent blindness to unenhanced vision is  prohibited.&#8221;</p>
<p>After the US agreed to the <a href="http://www.hrw.org/en/news/1998/07/28/hrw-questions-us-laser-programs-blinding-laser-weapon-ban-becomes-international-law">Blinding Laser Protocol in 1995</a> under  President Clinton, the Pentagon was forced to cancel several blinding  laser weapon programs that were in the works. But the PHaSR rifle can  skirt this regulation because the blinding effect is apparently  temporary due to its low-intensity laser.</p>
<p>According to a <a href="http://jnlwp.defense.gov/misc/fact_sheets/PHaSR%20fact%20sheet_v2%20from%20Kirtland%2030%20June%2006%20-%20FINAL.pdf">U.S. Air Force fact sheet</a>,  &#8220;The laser light from PHaSR temporarily impairs aggressors by dazzling  them with one wavelength. The second wavelength causes a repel effect  that discourages advancing aggressors.” The JNLWP website <a href="http://jnlwp.defense.gov/future_capabilities/lip.html">says</a> that a  significant amount of research and experimentation is still required to  gain a full understanding of the safety, military effectiveness, and  limitations of these future capabilities.</p>
<p>3. The Taser on Steroids</p>

<p>The <a href="http://www.krqe.com/dpp/news/crime/apd-gets-taser-shotguns-">Albuquerque Police Department now has Taser shotguns</a> in  its arsenal. Most of us are familiar with hand-held Tasers and  understand that they only work if the police are standing pretty close  to you (about 20 feet).</p>
<p>But Taser has developed the <a href="http://taser.com/products/law-enforcement/taser-x12">Taser X12</a>, a 12-gauge shotgun that instead of firing lethal bullet rounds, is designed to fire Taser projectile rounds. Known as <a href="http://taser.com/products/military/taser-xrep">Extended Range Electronic Projectiles</a> (XREP),  the XREP cartridge is a self-contained, wireless projectile that  delivers the same neuro-muscular incapacitation bio-effect (a fancy way  of saying electric shock) as the handheld Taser, but up to 100 feet.</p>
<p>According to a July 21 <a href="http://www.marketwatch.com/story/taser-and-metal-storm-sign-mou-2011-07-21?reflink=MW_news_stmp">press release</a>,  Taser International has taken the XREP to the next level, teaming up  with the Australian electronic gun company Metal Storm to enhance the  12-gauge <a href="http://www.metalstorm.com/content/view/83/167/">Multi-Shot Accessory Under-Barrel Launcher</a> (MAUL).</p>
<p>The two companies will combine Metal Storm&#8217;s MAUL stacked projectile  technology to &#8220;provide semi-automatic fire as fast as the operator can  squeeze the trigger,&#8221; which boasts a full weapon reload of up to five  rounds in less than two seconds. Picture five rounds of Taser XREP  cartridges flying out in less than two seconds up to 30 yards away &#8212;  that is the plan.</p>
<p>In September 2010 Raw Story <a href="http://www.rawstory.com/rs/2010/09/05/taser-related-deaths-accelerating/">reported</a> that  the rate of Taser-related deaths were on the rise. The story cited an  Amnesty International report from 2008 that found 351 Taser-related  deaths in the US between June 2001 and August 2008, a rate of just  slightly above four deaths per month. About <a href="http://www.bostonreview.net/BR36.1/nevins.php">90 percent</a> of  the victims were unarmed and did not appear to pose any serious threat,  according to an article in the Boston Review. The Amnesty report points  out that Tasers are “inherently open to abuse as they are easy to carry  and easy to use and they can inflict severe pain at the push of a  button without leaving substantial marks.“ In Amnesty&#8217;s US 2010 report,  the Taser-related death toll had <a href="http://www.amnestyusa.org/research/reports/annual-report-usa-2010?page=3">increased to 390</a>.   If the MAUL-Taser combined shooter find its way into police  departments around the country, it may not bode well for the rate of  Taser-related deaths.</p>
<p>Another project of Taser International, which was unveiled in 2009, is the <a href="http://taser.com/products/law-enforcement/taser-shockwave-ecd">Shockwave Area-Denial System</a>,  which blankets a large area with electrified darts, and a wireless  Taser projectile with a 100-meter range, helpful for picking off  “ringleaders” in unruly crowds. In 2007, Taser&#8217;s French distributor <a href="http://afp.google.com/article/ALeqM5i_qln4UXVmKbqgq42Tcis4BRjxuw">announced plans</a> for  a stun-gun-equipped flying saucer that fires stun darts at criminal  suspects or rioters; however, it has yet to be unveiled. Clearly there  is no limit to Taser International’s capacity for creativity.</p>
<p>4. Calmative Agents for Riot Control</p>
<p>Calmatives are chemical or biological agents with sedative, sleep-inducing or similar psychoactive effects. Although <a href="http://tinyurl.com/5cqk2y">the 1997 Chemical Weapons Convention</a> prohibits the use of riot control agents in warfare, JNWLP and NIJ have <a href="http://www.ncstl.org/news/July07DaggettPharmacological%20Overview%20of%20Calmatives">long considered</a> calmatives  for both military and law enforcement applications, such as dispersing a  crowd, controlling a riot or calming a noncompliant offender.</p>
<p>The most well-known and widely used riot-control agents are tear gas  (CS) and chloroacetophenone (CN), also known as mace. A few ways that  more advanced non-lethal calmatives <a href="http://www.ncstl.org/news/July07DaggettPharmacological%20Overview%20of%20Calmatives">might be administered</a>,  depending on the law enforcement environment, would include a topical  or transdermal skin application, an aerosol spray, an intramuscular  dart, or a rubber bullet filled with an inhalable agent.</p>
<p>In the March 2010 issue of Harper&#8217;s magazine, Ando Arike gives an extensive overview of riot control technology in his article &#8220;<a href="http://www.harpers.org/archive/2010/03/0082866">The Soft Kill: New Frontiers in Pain Compliance</a>.&#8221; He wrote:</p>
<blockquote><p>Pentagon interest in “advanced riot-control agents” has long been an  open secret, but just how close we are to seeing these agents in action  was revealed in 2002, when the Sunshine Project, an arms-control group  based in Austin, Texas, posted on the Internet a trove of Pentagon  documents uncovered through the Freedom of Information Act. Among these  was a fifty-page study titled “The Advantages and Limitations of  Calmatives for Use as a Non-Lethal Technique,” conducted by Penn State’s  Applied Research Laboratory, home of the JNLWD-sponsored Institute for  Non-Lethal Defense Technologies.</p>
<p>Penn State’s College of Medicine researchers agreed, contrary to  accepted principles of medical ethics, that “the development and use of  non-lethal calmative techniques is both achievable and desirable,”  and identified a large number of promising drug candidates, including  benzodiazepines like Valium, serotonin-reuptake inhibitors like Prozac,  and opiate derivatives like morphine, fentanyl, and carfentanyl,  the last commonly used by veterinarians to sedate large animals. The  only problems they saw were in developing effective delivery vehicles  and regulating dosages, but these problems could be solved readily, they  recommended, through strategic partnerships with the pharmaceutical  industry.</p>
<p>Little more was heard about the Pentagon’s “advanced riot-control  agent” program until July 2008, when the Army announced that production  was scheduled for its XM1063 “non-lethal personal suppression  projectile,” an artillery shell that bursts in midair over its target,  scattering 152 canisters over a 100,000-square-foot area, each  dispersing a chemical agent as it parachutes down. There are many  indications that a calmative, such as fentanyl, is the intended  payload—a literal opiate of the masses.</p></blockquote>
<p>5. Screaming Microwaves That Pierce the Skull</p>

<p>Researchers are in the process of developing the <a href="http://www.navysbirprogram.com/NavySearch/Summary/summary.aspx?pk=F5B07D68-1B19-4235-B140-950CE2E19D08">Mob Excess Deterrent Using Silent Audio</a> or  MEDUSA (that&#8217;s right, from Greek mythology), which uses a beam of  microwaves to induce uncomfortable auditory sensations in the skull. The  device <a href="http://www.newscientist.com/article/dn14250-microwave-ray-gun-controls-crowds-with-noise.html">exploits the microwave audio effect</a>,  in which short microwave pulses rapidly heat tissue, causing a  shockwave inside the skull that can be detected by the ears. MEDUSA’s  audio effect is loud enough to cause discomfort or even incapacitation.  It may also <a href="http://www.wired.com/dangerroom/2008/07/the-microwave-s/">cause a little brain damage</a> from the high-intensity shockwave created by the microwave pulse.</p>
<p>MEDUSA&#8217;s intended purpose is deterring crowds from entering a  protected perimeter, like a nuclear site, and temporarily incapacitating  unruly individuals. So far the weapon remains in development and is  funded by the Navy.</p>
<p>6. Ear-Splitting Siren</p>

<p>The<a href="http://www.wired.com/dangerroom/2007/05/outside_at_the_/"> Long Range Acoustic Device</a>,  or LRAD, built by American Technology Corporation, focuses and  broadcasts sound over ranges of up to hundreds of yards. LRAD has been  around for years, but Americans first took notice when police used it in  Pittsburgh to ward off protesters at the <a href="http://www.guardian.co.uk/world/2009/sep/24/g20-pittsburgh-protest-police">2009 G-20 summit</a>. It is generally used in <a href="http://www.wired.com/dangerroom/2009/09/sonic-warfare-erupts-in-pittsburgh-honduras/">two ways</a>: as  a megaphone to order protesters to disperse; or, if they disobey, as an  “ear-splitting siren” to drive them away. While LRAD may not be deadly,  it <a href="http://www.wired.com/dangerroom/2009/09/sonic-blaster-deployed-to-local-political-events-beach-competition/">can permanently damage hearing</a>, depending on how it’s used.</p>
<p>Similar sonic blasters have proven deadly. One is the Thunder  Generator, an Israeli-developed shock wave cannon used by farmers to  scare away crop-threatening bird. According to a Defense  News report last year, the Israeli Ministry of Defense has licensed a  firm called ArmyTec to <a href="http://www.defensenews.com/story.php?i=4447499&amp;c=FEA&amp;s=TEC">market the Thunder Generator</a> for military and security applications.</p>
<p>It works using gas from a cylinder of domestic liquid petroleum,  which is mixed with air and then detonated, producing a series of  high-intensity blasts. Patented “pulse detonation” technology ensures  high-decibel blasts. With an effective range of up to 50 meters, the  makers say it is extremely loud but will not do any lasting damage. They  warn, however, that within 10 meters the Thunder Generator could <a href="http://www.wired.com/dangerroom/2010/01/a-sonic-blaster-so-loud-it-could-be-deadly/#more-21519">cause permanent damage or even death</a>.</p>
<p>The Impact</p>
<p>The application of pain to control or coerce people into submission  helps achieve the desired aims of perception management, while  sheltering the public from the brutality of such devices.</p>
<p>Perhaps these less-lethal tactics for crowd control do result in  fewer injuries. But they also severely weaken our capacity to enact  political change. Authorities have ever more creative ways to manage  dissent, at a time when the need for change by popular demand is vital  to the future of our society and the planet.</p>

<h2>Miami  Police Smashed Mobile Phones Belonging to People Who Witnessed  Shooting; One Witness Hid His Phone’s Memory Card in His Mouth</h2>
<p><small>June 4th, 2011 </small></p>
<p>This is a pretty timely development, coming just a day after the news about <a href="http://cryptogon.com/?p=22722">Apple’s iCensor technology</a>.</p>

<p><em>On Thursday, The Miami Herald spoke to the couple that saw the  end of the 4 a.m. police chase on Collins Avenue, then watched and  filmed from just a few feet away as a dozen officers fired their guns  repeatedly into Raymond Herisse’s blue Hyundai. They say the only reason  they were able to show the video to a reporter is because they hid a  SIM card after police allegedly pointed guns at their heads, threw them  to the ground and smashed the cell phone that took the video.</em></p>
<p><em>The three-minute video captured on Narces Benoit’s HTC EVO phone  begins as officers crowd around the east side of Herisse’s car with guns  drawn. Roughly 15 seconds into the video, officers open fire.</em></p>
<p><em>Benoit filmed the incident from the sidewalk on the northeast  corner of 13th Street and Collins Avenue, close enough to see some  officers’ faces and individual muzzle flashes.</em></p>
<p><em>Shortly after the gunfire ends, an officer points at Benoit and  police can be heard yelling for him to turn off the camera. The voices  are muffled at times. The 35-year-old car stereo technician drops his  hand with the camera and hurries back to his Ford Expedition parked  further east on 13th Street.</em></p>
<p><em>The video shows Benoit get into the car, where his girlfriend,  Ericka Davis, sat in the driver’s seat. He raises his camera and an  officer is seen appearing on the driver’s side with his gun drawn,  pointed at them.</em></p>
<p><em>The video ends as more officers are heard yelling expletives, telling the couple to turn the video off and get out of the car.</em></p>
<p><em>“They put guns to our heads and threw us on the ground,” Davis said.</em></p>
<p><em>Benoit said a Miami Beach officer grabbed his cell phone, said  “You want to be [expletive] Paparazzi?” and stomped on his phone before  placing him in handcuffs and shoving the crunched phone in Benoit’s back  pocket. He said the couple joined other witnesses already in cuffs and  being watched by officers, who were on the lookout for two passengers  who, police believe at the time, had bailed out of Herisse’s car. It is  still not known whether any passengers were in the car.</em></p>
<p><em>Four bystanders were shot in the gunfire and three officers suffered minor injuries.</em></p>
<p><em>Benoit and Davis said officers smashed several other cell phones in the ensuing chaos.</em></p>
<p><em><strong>Benoit said the officers eventually uncuffed him after  gunshots rang out elsewhere and he discreetly removed the SIM card and  placed it in his mouth.</strong></em></p>
<p><em>Officers again took his phone, demanding his video. He said they  took him to a nearby mobile command center, snapped a picture of him,  then took him to police headquarters and conducted a recorded interview  while he kept the SIM card in his mouth. He insisted his phone was  broken.</em></p>

<p>Until we figure out how to make a phaser that can be set to stun,  we&#8217;ve been stuck with non less-lethal options like tasers (which can  kill) and laser dazzlers (which can cause eye damage). StunRay is  basically just a big flashlight, except with the ability to disable you  by causing &#8220;inverse blindness.&#8221;</p>
<p>If you&#8217;re wondering what inverse blindness looks like, it&#8217;s easy  to do to yourself: just stare at a bright light for a minute or two and  then look around. It&#8217;s not dark, really, but you can&#8217;t see anything very  well, and it&#8217;s because the exposure to bright light has overloaded the  neurons that connect your retinas to your brain, and mostly all you can  see is a featureless white expanse. The technical term for this is &#8220;loss  of contrast sensitivity,&#8221; and it&#8217;s an effective way of disabling  someone.</p>
<p>A company called Genesis Illumination is working what&#8217;s basically a  giant fancy flashlight called StunRay that can inflict this loss of  contrast sensitivity or inverse blindness or neural overload or whatever  you want to call it on people at long range in a split second. Each  burst of super bright light incapacitates subjects for five seconds or  so without causing any pain, and subjects fully recover in about five  minutes. The &#8220;fully recover&#8221; bit is key, since StunRay won&#8217;t roast your  eyeballs like a laser dazzler can.</p>
<p>StunRay uses a 75 watt bulb, which doesn&#8217;t seem like much, but with  some fancy optics, the device is able to focus its light beam to be ten  times brighter than an aircraft landing light, even up to 150 feet away.  And in case you were wondering, and I&#8217;m sure you were, this is bright  enough to read a newspaper from a mile away.</p>
<p>Genesis Illumination just received a patent for StunRay, so in the  near future, we&#8217;ll be able to rely on one single device for both our  disabling and long distance newspaper-reading needs.</p>

<div>The increasing <a href="http://www.activistpost.com/2010/08/ultimate-betrayal-police-and-military.html">militarization of police</a> has   had profound social ramifications across the United States, as  citizens  increasingly feel threatened by those sworn to protect them.   Beyond  the social fallout, a recent <em>Associated Press</em> <a href="http://abcnews.go.com/US/wirestory?id=11876706&amp;page=1" target="_blank">investigation</a> skims the surface of the financial impact of police excesses over the previous decade.</div>
<div>In typical <em>Associated Press</em> misdirection, a   video accompanies the article, which literally has nothing to do with   what is written around it.  The original title of the article   is ambiguous, &#8220;AP Investigation: Nearly $1B in NYC Police Payouts.&#8221;  If   one were only to watch the video, one would assume that the $1B somehow   has been paid out in counterterrorism operations, as the video focuses   on a &#8220;dirty bomb&#8221; patrol boat protecting the UN building.  Strange.    However, the article itself does possess a few kernels of truth.</div>
<div>According to the <em>AP</em> investigation into the NYPD:</div>
<blockquote><p>Nearly  $1 billion has been paid over the past decade to  resolve claims against  the nation&#8217;s largest police department . . . the  total spending  outstrips that of other U.S. cities, though some  smaller cities and  departments also shell out tens of millions of  dollars a year in  payouts.</p></blockquote>
<p>These payouts  often are due to  provable wrongdoing by individuals, yet ultimately fall  on the taxpayer  according to the report, as &#8220;officers themselves don&#8217;t  usually bear  personal responsibility.&#8221;  It is precisely this lack of  personal  responsibility which contributes to the overall impact on  society.   There are countless examples of police who have been  repeatedly cited  for brutality and other ethics violations being  protected by the &#8220;thin  blue line&#8221; of the supposed police honor code that  too often protects  their fraternity above protecting the public.</p>

<p>You&#8217;re   concerned with the way a death is being handled by the police in your   small town of only 1000 people.  You go to City Hall to complain.    Instead of having your voice be heard, the town Police Chief beats the   hell out of you and slams your face into the ground.  His assault   results in you dislocating your knee, bruising your ribs, and leaves you   with a black eye and $1500 in medical bills.</p>
<p>That is exactly what happened to 50 year old Brenda Martin of Le Flore County Florida, <a href="http://newsok.com/wister-woman-contests-arrest-says-chief-used-excessive-force/article/3495447">according to a NewsOK report</a>:</p>
<blockquote><p>Martin said she confronted Police Chief Chris Ford in his office that afternoon. He asked her to leave.<br />

As she was leaving, a security camera in town hall captured video of   Martin being pushed, her legs quickly swept from beneath her and Ford   holding her arms behind her back as he pushes her into the floor.</p></blockquote>
<p>According   to the Police Chief&#8217;s lawyer, his actions were perfectly justified   because she was &#8220;cursing in an extremely loud voice.&#8221;</p>
<p>Clearly  being cursed at is just too much to handle for a trained peace   officer, perhaps he was having flashbacks to his time in the middle east   while he was &#8220;serving in the Oklahoma National Guard.&#8221;  Doing his   patriotic duty, he shoved her around before tripping her and slamming   her face into the ground.  Of course, he says he tripped her and she   simply &#8220;went to the ground.&#8221;  The laws of physics dictated her fall, not   his direct actions.</p>
<p>Luckily for Brenda Martin, it was all  caught on tape.  She got the tape  after multiple requests and posted it  to the ultimate arbiter of  justice, Youtube.</p>

<p>Interestingly in order to justify his abuses the police officer claimed   it was all done because she was being arrested.  And yet, according to   the new acting Police Chief Randy Liles, &#8220;There is no arrest or  incident  report on file at the department.&#8221;  Despite it all, Liles  assures us  once Ford&#8217;s unrelated leave of absence is over &#8220;he&#8217;ll be  reinstated.&#8221;</p>

<li><a href="http://is.gd/bZIb9" target="_blank">A Rainbow City Alabama police officer</a> who was arrested for theft by fraud for keeping a rental item was later suspended over a separate, but unspecified, allegation of misconduct. What kind of misconduct? Don’t know, it’s a secret.</li>
</ul>
<ul>
<li><a href="http://is.gd/bZHZh" target="_blank">A Chino California police officer</a> who fatally shot an innocent bystander who sought shelter behind a car during a shootout between cops and some robbers is the subject of a lawsuit over the incident after the DA refused to press charges.</li>
</ul>
<ul>
<li><a href="http://is.gd/bZHjB" target="_blank">Two Framingham Massachusetts drug cops</a> are on paid leave while they are under investigation into unspecified allegations of misconduct that the chief claims may be criminal in nature.  What kind of misconduct? Again, don’t know, it’s a secret.</li>

<li><a href="http://is.gd/bZlNG" target="_blank">A Maui Hawaii police officer </a>was arrested on felony charges of promotion of a dangerous drug and possession of drug paraphernalia.</li>
</ul>
<ul>
<li><a href="http://is.gd/bZjba" target="_blank">A Bloomington Illinois police sergeant</a> has retired just prior to disciplinary action was planned to be taken against him after an investigation into unspecified misconduct. The chief expressed his frustration that police officer bill of rights legislation there prevented him from saying what it involved.</li>

<li><a href="http://is.gd/bZiuE" target="_blank">A Charlotte-Mecklenburg North Carolina police officer</a> was suspended for two days for refusing orders to take a homeless man to jail. The man froze to death later that night.</li>
</ul>

<li><a href="http://is.gd/bZibS" target="_blank">A Banning California police officer</a> was charged with six counts of insurance fraud along with his father and two of his friends after they fraudulently reported their truck stolen. The insurance company’s investigation found that they drove it to Mexico after reporting the alleged theft.</li>

<li><a href="http://is.gd/bZfIW" target="_blank">The Spring Hill Tennessee police chief</a> and the assistant chief have resigned while under investigation by state and federal authorities over alleged missing funds in that department.</li>

<li><a href="http://is.gd/bZaq5" target="_blank">A Denver Colorado police officer</a> is the subject of lawsuit after apparently caught on video following a man into an apartment building and allegedly attacking him from behind for jaywalking.</li>
</ul>

<li><a href="http://is.gd/bZ4VZ" target="_blank">A West Jordan Utah police officer</a> was charged with distributing drugs &amp; misuse of public funds for stealing drugs and cash from drug busts.</li>
</ul>

<li><a href="http://is.gd/bYVcF" target="_blank">The Vineland New Jersey police department</a> was sued by one of their police officers who alleges that the department tried to keep him quiet after he tried to report his fellow cops for drug crimes.</li>

<li><a href="http://is.gd/bYPMj" target="_blank">The police chief-elect of New Franklin Missouri</a> might be fired before he takes office after he was arrested on DUI charges.</li>
</ul>

<li><a href="http://is.gd/bYPyF" target="_blank">The Chula Vista California police chief</a> is under investigation after a former business partner accused him of fraudulently writing checks to himself on the company account after he had given up his position with the company to be chief.</li>
</ul>
<ul>
<li><a href="http://is.gd/bYOm7" target="_blank">A Dumfries Virginia police sergeant</a> is on leave while he’s the subject of an investigation that involves at least three other officers. The details of the multiple external investigations into the department are being kept secret due to the police officer’s bill of rights there.</li>
</ul>
<ul>
<li><a href="http://is.gd/bYMZc" target="_blank">A Brown County Illinois deputy</a> who is assigned to a regional task force has resigned while the subject of an investigation into sexual misconduct and allegations that he pressured an informant to help with drug busts against people she knew didn’t do drugs.</li>
</ul>
<ul>
<li><a href="http://is.gd/bYLWn" target="_blank">The now-former Minneapolis Parks Minnesota police chief</a> who is already facing 2 criminal sexual conduct charges involving minors is now accused of molesting 17 other kids, though prosecutors fear those cases are beyond the statute of limitations.</li>
</ul>
<ul>
<li><a href="http://is.gd/bYHHG" target="_blank">An Acworth Georgia police officer</a> was sentenced to probation for making false statements to the FBI about illegal gun sales.</li>
</ul>
<ul>
<li>And finally, <a href="http://is.gd/bYKEf" target="_blank">A Thief River Falls Minnesota police officer</a> has plead guilty to possession of over $91,000 worth of stolen goods and has taken an Alford plea on allegations that he stole a lawn mower.</li>
</ul>

<p>A south suburban Chicago police officer was caught on a security camera beating up a high school special education student, CBS2 <a href="http://cbs2chicago.com/investigations/caught.on.tape.2.1232197.html">reports</a>.</p>
<p>Marshawn Pitts, 15, was walking down his school hallway when he says a Dolton, Ill. police officer went from berating him for his untucked shirt to slamming him to the ground and beating him.</p>
<p>&#8220;The officer was in his face because he didn&#8217;t have his shirt tucked in,&#8221; Pitts&#8217; attorney <a href="http://cbs2chicago.com/investigations/caught.on.tape.2.1232197.html">told CBS 2&#8242;s Davis Savini</a>. &#8220;That&#8217;s the officer put in that school to protect these kids, and instead of doing that, this officer is literally assaulting this kid.&#8221;</p>
<p>Neither school nor Dolton officials responded to CBS 2 about the story.</p>

<p>In 2007, Shreveport police officer Wiley Willis arrested 38-year-old Angela Garbarino on suspicion of drunken driving. While in custody, as captured on the video below, Garbarino began arguing with Willis about what she said was her right to make a phone call. About a minute later, Willis walked over and turned off the video camera. When the camera returns back on, Garbarino was lying on the floor in a pool of her own blood. She was later photographed with <a href="http://jonathanturley.files.wordpress.com/2009/08/angela-garbarino.jpeg">severe facial injuries</a> that looked to have come from a beating. Willis’ attorney stated that she tripped and fell while the camera was off. After the video went viral, Willis was fired, but never criminally charged.</p>
<p>Last month, the Shreveport Municipal Fire and Police Civil Service Board <a href="http://www.shreveporttimes.com/article/20090813/NEWS03/908130319">voted to reinstate Willis on the police force.</a> He’ll get full back pay and benefits for the year-and-a-half he was fired. The reason? During the internal investigation of Willis, a polygraph machine operator failed to record the results of his Q&amp;A with Willis. This apparently is a violation of Louisiana’s <a href="http://www.ose.louisiana.gov/laws/pobor.htm">“Police Officer’s Bill of Rights,”</a> a set of guidelines every department must follow when investigating officer misconduct.</p>
<p>Garbarino won a $400,000 settlement from the city of Shreveport last year.</p>

It was his first day in Miami and Jordan Chusid got an intimate look at how aggressive cops can be down here.</p>
<p>The twentysomething college student had just transferred to the University of Miami from the University of Central Florida when two cops pulled their guns on him, ordering him to get down.</p>
<p>Apparently, he fit the description of somebody who had stolen a motorcycle earlier that day from campus.</p>
<p>The incident, which occurred last Wednesday, was caught on video by <a onclick="javascript:pageTracker._trackPageview('/outgoing/www.themiamihurricane.com/2009/08/30/umpd-pull-gun-on-student-in-case-of-mistaken-identity/');" href="http://www.themiamihurricane.com/2009/08/30/umpd-pull-gun-on-student-in-case-of-mistaken-identity/" target="_blank">communications students</a> who were in the area filming.</p>
<p>They handcuffed him and were about to take him to jail when they realized he was not the suspect they were after. So they let him go with a curt apology.</p>
<p>Just another day in paradise.<br />

<p>A Boise, Idaho, police officer who pushed a Taser inside a man’s buttocks and threatened to “Taser his balls” violated use-of-force policy, but didn’t break the law, an ombudsman has found.</p>
<p>The man in question, whose identity is being withheld, plans to sue the Boise police.</p>
<p>On February 14 of this year, the “complainant,” as he is called in police reports, physically blocked the  <a onclick="document.getElementById('more_item').style.display='none'; document.getElementById('less_item').style.display='inline'; document.getElementById('desc_item').style.display='inline';" href="javascript://"><strong>More..</strong></a>door to his residence when police arrived to investigate a domestic disturbance. Believing the police officers, who he claims did not identify themselves, to be a person coming to “beat him up,” he refused to allow them entry.</p>
<p>When officers forced their way in, “three officers rushed in and within nine seconds, had the man face down on the floor and had deployed the Taser against the small of his back. Only after the first [tasing] did they order his hands behind his back,” reports the Boise Weekly.</p>
<p>In a report, Boise Community Ombudsman Pierce Murphy “said the officer who used the Taser — described as Officer #3 in the report — also coarsely threatened to use the Taser in the man’s anus and genitals. Murphy’s report says that use of Taser on a man’s buttock’s does not violate policy in and of itself,” reports the Idaho Statesman.</p>
<p>The Statesman printed a transcript of an audio recording of the altercation:</p>
<p>Officer #3: Do you feel this?<br />
Complainant: Yes, sir.<br />
Officer #3: Do you feel that? That’s my -<br />
Complainant: Okay<br />
Officer #3: -Taser up your ass.<br />
Complainant: Okay<br />
Officer #3: So don’t move.<br />
Complainant: I’m trying not to. I can’t breathe.<br />
…<br />
Officer #3: Now do you feel this in your balls?<br />
Complainant: I do, sir. I’m not going to move. I’m not gonna move.<br />
Officer #3 Now I’m gonna tase your balls if you move again.<br />
A minute later, this exchange occurred:<br />
Officer #3: Okay, I’m gonna take this Taser out of your asshole now. Are you going to fight with me?<br />
Complainant: No, not at all, sir.</p>
<p>The Statesman is now reporting that the complainant “plans to sue the Boise Police Department for excessive use of force.”</p>
<p>The Boise Weekly quotes Boise Police Chief Mike Masterson as saying the allegation against the officer is “one of the most serious charges that an officer can face … It is an offense that is very likely to lead to termination.”</p>
<p>But the complainant’s lawyer, Ron Coulter, said that the officer in question is still walking his beat.</p>
<p>“I don’t think he should be back on the street, but then I’m not the chief of police,” Coulter told the Boise Weekly. “When you do things like he did I’m not sure that person’s even fit to wear a uniform.”<br />

The fact that they have not stripped Daniel Martin of his badge and gun is a crime in itself.</p>
<p>The dash cam video not only reveals that he falsified a police report &#8211; which has landed <a href="http://carlosmiller.com/2009/06/11/two-former-cops-jailed-for-beating-suspect-then-lying-about-it/" target="_blank">other cops</a> in jail &#8211; but that he is about as insecure and unstable as a three-year-old child.</p>
<p>First of all, he had absolutely no reason to be speeding with his sirens wailing. All he was doing was picking up his wife at what appears to be a police station.</p>
<p>Then, after he picked up his wife, he pulls the ambulance over for failing to yield in what essentially was a non-emergency situation. In fact, the only vehicle that had an emergency on its hands was the ambulance, which was transporting a patient to the hospital.</p>
<p>And after the ambulance pulls over, both paramedics step out of the vehicle in a non-threatening manner. There was no “assault”, as the cop <a onclick="javascript:pageTracker._trackPageview('/outgoing/www.news9.com/global/story.asp?s=10427244');" href="http://www.news9.com/global/story.asp?s=10427244" target="_blank">initially reported. </a>He didn’t even slam the door, as he <a onclick="javascript:pageTracker._trackPageview('/outgoing/newsok.com/oklahoma-highway-patrol-trooper-cites-gesture-in-report-on-scuffle/article/3374472');" href="http://newsok.com/oklahoma-highway-patrol-trooper-cites-gesture-in-report-on-scuffle/article/3374472" target="_blank">later reported.</a></p>
<p>All the paramedic was trying to do was his job, which was to get to the patient to the hospital as quick as possible.</p>
<p>And for that, Martin not only placed him in a chokehold, he told the paramedics that he was going to shoot them dead with his gun.</p>
<p>The fact that prosecutors<a onclick="javascript:pageTracker._trackPageview('/outgoing/www.officer.com/web/online/Top-News-Stories/No-Charges-Filed-in-Oklahoma-Trooper--Paramedic-Scuffle/1006');" href="http://www.officer.com/web/online/Top-News-Stories/No-Charges-Filed-in-Oklahoma-Trooper--Paramedic-Scuffle/1$47006" target="_blank"> refused to file charges </a>on the cop proves they are nothing but a bunch of backwoods, slack jawed good ole boys who will always watch out for their own.</p>
<p>And they are putting the public in danger in the process.<br />
