<p>Yesterday, at &#8220;Guantánamo Forever?&#8221; <a href="http://newamerica.net/events/2012/guant_namo_forever">an event at the New America Foundation in Washington D.C.</a>, attorney Tom Wilner and journalist Andy Worthington launched &#8220;<a href="http://www.closeguantanamo.org/">Close Guantánamo</a>,&#8221; a new campaign and website designed to provide education about the ongoing injustice of Guantánamo, to provide a focus for those who believe that the prison must be closed, and to provide methods for people to show their support for the closure of Guantánamo. <a href="http://www.closeguantanamo.org/Join-Us"><strong>A sign-up page is here</strong></a>, where supporters can help to build up a body of opposition to the ongoing existence of Guantánamo, and to show the Obama administration, Congress and the media how many people are dissatisfied with the President’s inability to close the prison, and the actions of Congress to actively prevent its miserable 10-year history from coming to an end.</span></p>
<p>In addition,<a href="https://wwws.whitehouse.gov/petitions/%21/petition/close-guantanamo-now/6cMPlxQw"><strong> a petition calling for the closure of the prison is on the White House’s &#8220;We the People&#8221; website, and 25,000 signatures are required within 30 days to secure a response from the White House.</strong></a></p>
<p>Below is the press release that was issued yesterday announcing the launch of the &#8220;Close Guantánamo&#8221; campaign and website. Please also join the campaign on <a href="http://www.facebook.com/CloseGuantanamo">Facebook</a> and <a href="http://www.twitter.com/closegitmo">Twitter</a>.</p>
<p>For the 10th anniversary of the opening of the &#8220;war on terror&#8221; prison at Guantánamo Bay, Cuba (on Jan. 11), a group of retired military personnel and lawyers are calling on President Obama to honor his promise to close the prison, which he made when he took office in January 2009.</p>
<p>Signatories to <a href="http://www.closeguantanamo.org/Our-Mission"><strong>the mission statement for the &#8220;Close Guantánamo&#8221; campaign</strong></a> include: Col. Lawrence Wilkerson, Chief of Staff to former Secretary of State Colin Powell; the Hon. John J. Gibbons, former Chief Judge, U.S. Court of Appeals for the Third Circuit; Gen. David M. Brahms (Ret.); Rear Adm. Donald J. Guter (Ret.); Rear Adm. John D. Hutson (Ret.); Col. Morris Davis, former chief prosecutor for the Military Commissions at Guantánamo; and several lawyers who have been involved in the litigation involving Guantánamo and the 171 prisoners still held there.</p>
<p>The mission statement also notes that over half of the remaining 171 prisoners — 89 men in total — have been cleared for release or transfer, and, as the signatories explain:</p>
<p>&#8220;It is unacceptable that the U.S. government continues to hold men that its own national security experts have recommended for release or transfer, and that Congress has intervened to maintain this deplorable state of affairs.&#8221;</p>
<p>The signatories also note:</p>
<p>&#8220;Guantánamo harms our nation every day it stays open, and it continues to serve as a potent symbol for terrorist recruitment.&#8221;</p>
<p>The &#8220;Close Guantánamo&#8221; campaign invites anyone opposed to the continued existence of Guantánamo to <a href="http://www.closeguantanamo.org/Join-Us">sign up to the campaign</a>, to show the President and Congress that there is significant support for the prison’s closure, and also to <a href="https://wwws.whitehouse.gov/petitions/%21/petition/close-guantanamo-now/6cMPlxQw">sign a petition on the White House’s &#8220;We the People&#8221; website</a>, calling for the prison’s closure. The White House commits to respond to any petition that receives 25,000 signatures within 30 days.</p>
<p>In the months to come, the website will feature stories of the remaining prisoners, via their lawyers, and important background information about the prison, the men held there, and the reasons why the prison is still open, to help people understand why this remains an issue of great importance.</p>
<p>The Steering Committee members are: Gary A. Isaac and Tom Wilner, attorneys who were involved in litigation on behalf of the Guantánamo prisoners before the Supreme Court, and Andy Worthington, journalist and author.</p>

<blockquote><p>TAMPA – No doubt you’ve heard the adage: <a href="http://www.dailypaul.com/196226/tampa-florida-police-torture-kill-ohio-man-with-pepper-spray">a picture is worth a thousand words.</a> A picture of 62-year-old Nick Christie could be worth thousands of dollars when a jury sees it.</p>
<p>The photo shows the Ohio man restrained inside the Lee County Jail with his body covered in pepper spray.</p>
<p>“This photo is a picture of a man who is strapped to a chair naked inside a jail for hours with a hood over his face. That evokes thoughts of being tortured,” says Cleveland-based lawyer Nick DiCello who represents the Christie family.</p>
<p>The photo, which was obtained by FOX 13′s investigative unit, was taken in the final hours of Christie’s life.</p>
<p>The District 21 Medical Examiner ruled his death was a homicide because he had been restrained and sprayed with pepper sprayed by law enforcement officers. But to this day, nobody has ever been charged with a crime, and the Lee County State Attorney cleared the sheriff’s office of any wrong doing.</p></blockquote>

<p><em>The Miami Herald’s Carol Rosenberg, returning to Gitmo for the arraignment of alleged USS Cole bomber Abd al-Rahim al-Nashiri, reports how much the island prison is costing American taxpayers these days.</em></p>
<p>The Pentagon detention center that started out in January 2002 as a collection of crude open-air cells guarded by Marines in a muddy tent city is today arguably the most expensive prison on earth, costing taxpayers $800,000 annually for each of the 171 captives by Obama administration reckoning.</p>
<p><em>That’s more than 30 times the cost of keeping a captive on U.S. soil.</em><br />

Bush arrives in Canada today to address a regional economic summit, where attendees will pay $599 a head to hear him and former President Bill Clinton as featured speakers, human right groups opposed to Bush’s visit, having petitioned the government to intervene, but with no response, are initiating a private prosecution, by four Guantánamo prisoners, accusing Bush of torture. In addition, campaigners on the ground are planning a huge protest.</p>
<p>It is anticipated that those turning out to protest Bush’s visit will dwarf the hundreds of protestors who turned up to campaign against a visit by former US Vice President <a href="http://www.andyworthington.co.uk/2011/09/10/ten-years-after-911-america-deserves-better-than-dick-cheneys-self-serving-autobiography/">Dick Cheney</a> in Vancouver last month, where the &#8220;Vice President for Torture&#8221; was addressing diners who had paid $500 a head for the privilege. As <a href="http://www.ctvbc.ctv.ca/servlet/an/local/CTVNews/20111019/bc_george_bush_protest_111019/20111019/?hub=BritishColumbiaHome">CTV News noted</a>, however, &#8220;The numbers at the Bush rally could dwarf those at the Cheney event because many protesters from the <a href="http://occupyvancouver.com/">Occupy Vancouver</a> movement camped out at the Vancouver Art Gallery are planning to head to Surrey to take part.&#8221;</p>
<p>Amnesty International got the ball rolling last week, <a href="http://www.amnesty.org/en/news-and-updates/report/canada-urged-arrest-and-prosecute-george-w-bush-2011-10-12">calling for Bush’s arrest</a> for war crimes and torture. In a press release, Susan Lee, Americas Director at Amnesty International, explained, &#8220;Canada is required by its international obligations to arrest and prosecute former President Bush given his responsibility for crimes under international law including torture. As the US authorities have, so far, failed to bring former President Bush to justice, the international community must step in.  A failure by Canada to take action during his visit would violate the <a href="http://www2.ohchr.org/english/law/cat.htm">UN Convention against Torture</a> and demonstrate contempt for fundamental human rights.&#8221;</p>
<p>Amnesty International &#8220;submitted a memorandum to the Canadian authorities on 21 September 2011 that makes a substantial case for the former president’s legal responsibility for a series of human rights violations,&#8221; and a further submission has been made by <a href="http://www.lawyersagainstthewar.org/">Lawyers Against War</a> (see <a href="http://www.globalresearch.ca/index.php?context=va&amp;aid=27076">here</a> for the letter by Gail Davidson to the Crimes against Humanity &amp; War Crimes Section of the government’s Citizenship and Immigration department). Furthermore, on September 29, the Center for Constitutional Rights (CCR) and the Canadian Centre for International Justice (CCIJ) submitted a <a href="http://www.ccrjustice.org/files/2011.09.29%20Bush%20Canada%20Indictment.pdf">69-page page draft indictment</a> to Attorney General Robert Nicholson, along with more than 4,000 pages of supporting material, setting forth the case against Bush for torture.</p>
<p>All of these entreaties were ignored, but today, as George W. Bush arrives in Canada, the four Guantánamo prisoners — <a href="http://www.andyworthington.co.uk/2011/06/11/wikileaks-and-the-22-children-of-guantanamo/">Hassan bin Attash</a>, <a href="http://www.andyworthington.co.uk/2008/04/13/sami-al-haj-the-banned-torture-pictures-of-a-journalist-in-guantanamo/">Sami el-Hajj</a>, <a href="http://www.andyworthington.co.uk/2009/09/03/who-are-the-two-syrians-released-from-guantanamo-to-portugal/">Muhammed Khan Tumani</a> and <a href="http://www.andyworthington.co.uk/category/murat-kurnaz/">Murat Kurnaz</a> (all released, with the exception of bin Attash) — will lodge a private prosecution in Provincial Court in Surrey, British Columbia against George W. Bush. <a href="http://www.ccrjustice.org/newsroom/press-releases/torture-victims-initiate-private-prosecution-against-george-w.-bush-his-arrival-canada">Further details</a> of this submission, by CCR and CCIJ, are below, and I congratulate them for their tenacity.</p>
<p>In February this year, George W. Bush <a href="http://www.andyworthington.co.uk/2011/02/15/george-w-bush-war-criminal-is-not-welcome-in-europe/">cancelled a planned visit to Switzerland</a>, after CCR and the European Center for Constitutional and Human Rights announced that they would be submitting a torture indictment and asking the Swiss government to arrest him when he landed on Swiss soil. I cross-posted that complaint <a href="http://www.andyworthington.co.uk/2011/02/19/the-indictment-for-torture-filed-against-george-w-bush-part-one-the-facts/">here</a>, and, as CCR’s Executive Director, Vince Warren, explained, although Bush cancelled that particular visit, the <a href="http://ccrjustice.org/ourcases/current-cases/bush-torture-indictment">Preliminary Bush Torture Indictment</a>, prepared by CCR and ECCHR, &#8220;provides a strong factual and legal basis to hold Bush accountable — in any of the 147 countries which have ratified the <a href="http://www.un.org/documents/ga/res/39/a39r046.htm">[UN] Convention Against Torture</a> (CAT) — for having authorized torture.&#8221;</p>
<p>It seems that the former President accepts that he is not welcome in Europe. What a shame that the Canadian government has not made it clear that he is also unwelcome in Canada.</p>
<h3>Torture Victims to Initiate Private Prosecution against George W. Bush on His Arrival in Canada</h3>
<p><em>Canadian Government Has Legal Obligation under UN Convention Against Torture to Prosecute Alleged Perpetrators of Torture, Rights Groups Say; Prominent Individuals and Organizations Sign on in Support.</em></p>
<p>October 19, 2011, Surrey, BC — Tomorrow, four individuals who allege they were tortured during George W. Bush’s tenure as president of the United States will lodge a private prosecution in Provincial Court in Surrey, British Columbia against the former president, who is due to visit Canada for a paid speaking engagement at the Surrey Regional Economic Summit on October 20. The four men will take this step after repeated calls to the Canadian Attorney General to open a torture investigation of George Bush went unanswered. Human rights groups and prominent individuals will sign on in support of the effort.</p>
<p>The four men — Hassan bin Attash, Sami el-Hajj, Muhammed Khan Tumani and Murat Kurnaz — each endured years of inhumane treatment including beatings, chaining to cell walls, being hung from walls or ceilings while handcuffed, lack of access to toilets, sleep, food and water-deprivation, exposure to extreme temperatures, sensory overload and deprivation, and other horrific and illegal treatment while in U.S. custody at military bases in Afghanistan and/or at the detention facility at Guantánamo Bay. While three of the plaintiffs have since been released without ever facing charges, Hassan bin Attash still remains in detention at Guantánamo Bay, though he too has not been formally charged with any wrongdoing.</p>
<p>&#8220;I lost my family, my father, my health, my education because of George Bush. Although I was completely innocent, I lost nearly 10 years of my life,&#8221; said former Guantánamo detainee and torture survivor Muhammed Khan Tumani. &#8220;I suffered greatly while detained at Guantánamo, and continue to suffer. I have restrictions on my travel and cannot travel to see my father who is ill. George Bush must face justice and be held accountable for his actions, which continue to cause me and so many harm.&#8221;</p>
<p>On September 29, the Center for Constitutional Rights (CCR) and the Canadian Centre for International Justice (CCIJ) submitted a <a href="http://www.ccrjustice.org/files/2011.09.29%20Bush%20Canada%20Indictment.pdf">69-page page draft indictment</a> to Attorney General Robert Nicholson, along with more than 4,000 pages of supporting material, setting forth the case against Bush for torture. The indictment, incorporated into the criminal information lodged today, contends that by Bush’s own admission he sanctioned and authorized acts that constitute torture under the Canadian criminal code and the Convention Against Torture (CAT).</p>
<p>Katherine Gallagher, a senior staff attorney at the Center for Constitutional Rights (CCR) who is assisting the plaintiffs, said, &#8220;George Bush’s <a href="http://www.andyworthington.co.uk/2010/11/06/no-appetite-for-prosecution-in-memoir-bush-admits-he-authorized-the-use-of-torture-but-no-one-cares/">brazen admission</a> to authorizing torture techniques and unlawful detentions, including enforced disappearances, must not be met with indifference. His years of impunity must come to an end. Even if the United States has failed to meet its obligations to hold torturers accountable, Canada has an opportunity and a legal obligation to position itself on the right side of history and the law.&#8221;</p>
<p>Matt Eisenbrandt, legal director of the Canadian Centre for International Justice (CCIJ), who will submit the filing on men’s behalf, added, &#8220;Canadian law could not be clearer. If an alleged torturer is present in Canada, the government has the power to prosecute. As a signatory of the Convention Against Torture, Canada has an obligation to initiate an investigation when Mr. Bush sets foot in this country.&#8221;</p>
<p>More than 50 human rights organizations from around the world and prominent individuals signed on to support the call for George W. Bush’s prosecution, including former UN Special Rapporteurs on Torture, Theo van Boven and Manfred Nowak, the International Federation for Human Rights, and the Canadian-based International Civil Liberties Monitoring Group. A number of the human rights organizations which signed on are facing the on-going harms of the &#8220;counterterrorism&#8221; policies advanced under the Bush administration and then adopted or employed in their own countries.</p>
<p>Former UN Special Rapporteur on Torture, Manfred Nowak, said: &#8220;The main aim of the UN Convention Against Torture was to eradicate safe havens for persons who commit, order, or participate in acts of torture worldwide. States parties to the Convention, including Canada, have a legal obligation to arrest all persons suspected of torture with the aim of bringing them to justice. There is plenty of evidence that President Bush authorized enhanced interrogation methods against suspected terrorists, some of which clearly amount to torture, such as waterboarding.&#8221;</p>
<p>Last February, the Center for Constitutional Rights, along with other human rights organizations, attempted to initiate criminal proceedings against Bush during a private speaking engagement in Geneva, but he canceled after news of the planned prosecution came to light. Following the cancellation, CCR and the European Center for Constitutional and Human Rights released the &#8220;<a href="http://www.ccrjustice.org/files/FINAL%207%20Feb%20BUSH%20INDICTMENT.pdf">Bush Torture Indictment</a>,&#8221; which can serve as the basis for country-specific indictments against Bush in any of the 147 countries that have ratified the UN Convention Against Torture or have universal jurisdiction laws for torture.</p>
<p>Prior to the filing of this case, CCR and the CCIJ twice (on <a href="http://www.ccrjustice.org/files/2011.09.29%20Cover%20Letter%20to%20Canadian%20Minister%20of%20Justice.pdf">Sept. 29, 2011</a> and <a href="http://www.ccrjustice.org/files/CCR%20CCIJ%20Follow%20up%20Letter%20s.pdf">Oct. 14, 2011</a>) petitioned Canadian Minister of Justice and Attorney General Robert Nicholson by letter to launch a criminal investigation against Bush during his October 20 visit to Canada, but received no response. George Bush and former U.S. vice president Dick Cheney both recently made trips to Canada, without any legal consequence.</p>

Former Secretary of Defense Donald Rumsfeld was stripped of immunity in a case involving the torture of two United States citizens.</p>

<p>Two FBI informants, Donald Vance and Nathan Ertel, were detained and tortured by United States military personnel in Iraq in 2006. They <a href="http://www.democraticunderground.com/discuss/duboard.php?az=view_all&amp;address=439x1970628"><span style="color: #9933cc;">filed suit</span></a> against Former Secretary of Defense Donald Rumsfeld for violations of their constitutional rights. <a href="https://www.judicialview.com/Court-Cases/International/Vance-v-Rumsfeld/33/37310"><span style="color: #9933cc;">The Judicial View</span></a> states:</p>
<blockquote><p><em>“Plaintiffs seek damages from Secretary Rumsfeld and others for their roles in creating and carrying out policies that caused plaintiffs’ alleged torture. Plaintiffs also bring a claim against the United States under the Administrative Procedure Act to recover personal property that was seized when they were detained.”</em></p></blockquote>
<p>Rumsfeld and the United States government moved to dismiss the charges, and were denied. The plaintiffs relayed “in sufficient detail facts supporting Secretary Rumsfeld’s personal responsibility for the alleged torture.”</p>

<p><em>A human rights group suing Cisco for aiding the tracking and torture of people in China claims it has new evidence proving the tech giant tailored its technology to specifically enable these abuses.</em></p>
<p>If accepted by the court, the revelations, including that Cisco trained Chinese officials in how to surveil net users, could prove damning for the company, which has always claimed it has done no more than sell stock standard technology to the regime.</p>
<p>The Human Rights Law Foundation, based in Washington, filed its suit against Cisco in May under a law that allows US companies to be sued for violations of human rights committed abroad.</p>
<p>The suit accuses Cisco, one of the world’s largest technology companies, of aiding the Chinese government in monitoring and jailing members of the banned Falun Gong by helping to develop the “Golden Shield Project”.</p>
<p>The case is running in parallel to a separate case, reported on by Fairfax Media last month, that was brought against Cisco on behalf of Chinese political prisoners who claim they were tortured and suppressed thanks to technology and training provided to the Chinese Communist Party by Cisco.</p>
<p><em>Their crime was little more than publishing articles on the internet criticising China’s one-party system and advocating regime change.</em><br />

<p><span style="font-family: Verdana,Arial; font-size: x-small;">A new study in the Journal of the American Medical Association reveals that physicians with the CIA&#8217;s Office of Medical Services (OMS) played an even greater role in facilitating the torture of detainees than was previously recognized.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">As described in the (subscription required) <a href="http://jama.ama-assn.org/cgi/content/short/304/5/569">study</a>, &#8220;In 2003, partially in response to a CIA Inspector General investigation that questioned the use of enhanced interrogation methods and criticized the agency’s failure to consult with OMS about the risks to detainees of waterboarding, OMS physicians assumed another role, providing opinions to the agency and lawyers whether the techniques used would be expected to cause severe pain or suffering and thus constitute torture.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">This advisory function came in addition to the physicians&#8217; previous <a href="http://rawstory.com/rs/2010/0607/doctors-group-bush-administration-conducted-medical-experiments-detainees/">involvement</a> in the torture of detainees through performing medical evaluations before and after interrogation, monitoring waterboarding sessions, and collecting information on the effectiveness and risks of various techniques.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">The study, titled &#8220;Roles of CIA Physicians in Enhanced Interrogation and Torture of Detainees,&#8221; was authored by Leonard S. Rubinstein, the president of Physicians for Human Rights, and Brig. Gen. (ret.) Stephen N. Xenakis, a former Army psychiatrist who is now with the Center for Public Health and Human Rights. It is based on a previously secret <a href="http://www.aclu.org/torturefoia/released/103009/cia-olc/2.pdf">document</a> from 2004, laying out OMS guidelines for detainee interrogation, which was released by the Obama administration.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">In an article for <em>Harper&#8217;s,</em> human rights lawyer Scott Horton <a href="http://harpers.org/archive/2010/08/hbc-90007469">notes</a> that the JAMA study makes it apparent that the OMS physicians did not merely offer a medical opinion as to what constituted torture but &#8220;gave their bosses exactly what was expected of them: a green light to torture.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">The study emphasizes that even though OMS approved the use of enhanced interrogation methods subject to &#8220;medical limitations,&#8221; those limitations took no account of actual pain and suffering and were merely calculated to minimize the chances of doing permanent physical damage.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">They &#8220;included durational limits for exposure to a specified temperature, either up to the time hypothermia would be expected to develop or on evidence of hypothermia; body weight loss of 10% or evidence of significant malnutrition as a result of dietary restrictions; and exposure to noise just under the decibel levels associated with permanent hearing loss. Stress positions were permitted for up to 48 hours provided the detainee’s hands were no higher than the head, weight was borne by lower extremities, and preexisting injuries were not aggravated. &#8230; The OMS guidelines also advised that emergency resuscitation equipment be available when waterboarding was used.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Although the guidelines specify that &#8220;the detainee&#8217;s physical condition must be such that these interventions will not have lasting effect,&#8221; they ignore professional literature on the potential health risks of the techniques, citing instead such sources as &#8220;&#8216;Wilderness Medicine&#8217; 4th Ed., Ch 6 &#8212; Accidental Hypothermia.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">&#8220;The duplicity in this affair is amazingly circular.,&#8221; Horton writes. &#8220;The Justice Department’s torture lawyers relied on the CIA’s torture doctors for the conclusion that specific techniques did not produce &#8216;severe pain&#8217; that ran afoul of the criminal law prohibition on torture; the CIA doctors relied on the Justice Department lawyers for the same conclusion. It looks like a compact, and an alert prosecutor would no doubt call it a joint criminal enterprise. &#8230; It’s hard to see at this point whose behavior was the more ethically odious, though evidence suggests that both engaged in professional misconduct so egregious as to warrant formal disciplinary proceedings.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">&#8220;The torture doctors expect to have their identities protected, and thus to escape the natural consequences of their gross professional misconduct,&#8221; Horton concludes. &#8220;This helps us understand why senior figures in the intelligence community are today ferociously pressuring the Justice Department to criminalize anyone who attempts to discover the identities of those involved. They assert that those identified would be terrorist targets. In fact, those who are unmasked face likely professional ethics proceedings, as well as the long-term risk of criminal prosecution, particularly if they ever venture beyond the borders of the United States.&#8221;</span></p>

<p><em>Stymied by political opposition and focused on competing priorities, the Obama administration has sidelined efforts to close the Guantánamo prison, making it unlikely that President Obama will fulfill his promise to close it before his term ends in 2013.</em></p>
<p><em>When the White House acknowledged last year that it would miss Mr. Obama’s initial January 2010 deadline for shutting the prison, it also declared that the detainees would eventually be moved to one in Illinois. But impediments to that plan have mounted in Congress, and the administration is doing little to overcome them.</em></p>
<p><em>“There is a lot of inertia” against closing the prison, “and the administration is not putting a lot of energy behind their position that I can see,” said Senator Carl Levin, the Michigan Democrat who is chairman of the Senate Armed Services Committee and supports the Illinois plan. He added that “the odds are that it will still be open” by the next presidential inauguration.</em><br />

<p>The allegation by doctors with expertise in prison experimentation and torture that the Bush administration conducted &#8220;illegal and unethical human experimentation and research&#8221; on detainees while in CIA custody after 9/11 is certainly newsworthy. See <a href="http://www.cbsnews.com/stories/2010/06/06/national/main6555679.shtml">this</a>, <a href="http://www.boingboing.net/2010/06/06/scott-allen-md-lead.html">this</a> and <a href="http://rawstory.com/rs/2010/0607/doctors-group-bush-administration-conducted-medical-experiments-detainees/">this</a>.</p>
<p>Specifically, Physicians for Human Rights &#8211; an international doctors&#8217; organization &#8211; <a href="http://www.truthout.org/human-experimentation-heart-bush-administrations-torture-program60199">alleges</a> that:</p>
<blockquote><p>High-value detainees captured during the Bush administration&#8217;s &#8220;war on terror,&#8221; who were subjected to brutal torture techniques, were used as &#8220;guinea pigs&#8221; to gauge the effectiveness of various torture techniques, a practice that has raised troubling comparisons to Nazi-era human experimentation.</p>
<p>***</p>
<p>&#8220;Health professionals working for and on behalf of the CIA monitored the interrogations of detainees, collected and analyzed the results of [the] interrogations, and sought to derive generalizable inferences to be applied to subsequent interrogations,&#8221; said the <a href="http://phrtorturepapers.org/?dl_id=9" target="_blank">27-page report</a>, entitled &#8220;Experiments in Torture: Human Subject Research and Evidence of Experimentation in the &#8216;Enhanced&#8217; Interrogation Program.&#8221; &#8220;Such acts may be seen as the conduct of research and experimentation by health professionals on prisoners, which could violate accepted standards of medical ethics, as well as domestic and international law. These practices could, in some cases, constitute war crimes and crimes against humanity.&#8221;</p>
<p>***</p>
<p>For example, CIA medical personnel obtained experimental research data by subjecting more than 25 detainees to individual and combined torture techniques, including sleep deprivation and stress positioning, as a way of understanding &#8220;whether one type of application over another would increase the subjects&#8217; susceptibility to severe pain,&#8221; the report said,  adding that the information derived from that research informed  &#8220;subsequent [torture] practices.&#8221;</p></blockquote>
<p>If the allegations are true, such experimentation would certainly violate the Nuremberg Code, the Geneva conventions, and the War Crimes Act of 1996.</p>
<p><span style="text-decoration: underline;">Nuremberg Code</span></p>
<p>Among other things, the <a href="http://ohsr.od.nih.gov/guidelines/nuremberg.html">Nuremberg  Code</a> prohibits experimentation conducted without the voluntary consent of the subject.  Voluntary consent means:</p>
<blockquote><p>The person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, over-reaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision. This latter element requires that before the acceptance of an affirmative decision by the experimental subject there should be made known to him the nature, duration, and purpose of the experiment; the method and means by which it is to be conducted; all inconveniences and hazards reasonable to be expected; and the effects upon his health or person which may possibly come from his participation in the experiment.</p></blockquote>
<p>Moreover, the Code requires that the subject be allowed to stop the experiment at any time &#8220;if he has reached the physical or mental state where continuation of the experiment seems to him to be impossible.&#8221;</p>
<p>The Code also requires that &#8220;the experiment should be so conducted as to avoid all unnecessary physical and mental suffering and injury.&#8221;</p>
<p>Here, the experimentation did not seek consent at any point. And &#8211; rather than limiting pain &#8211; the experimentation was specifically conducted as a way to determine how to maximize the pain the subject  would experience.</p>
<p><span style="text-decoration: underline;">Geneva Convention and War Crimes Act</span></p>
<p>The Geneva Conventions prohibit torture, mutilation or humiliating and degrading treatment. For example, the Fourth Geneva Convention <a href="http://en.wikipedia.org/wiki/Fourth_Geneva_Convention">prohibits</a>:</p>
<blockquote><p>(a) violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture; [or]</p>
<p>(c) outrages upon personal dignity, in particular humiliating and degrading treatment</p></blockquote>
<p>And the War Crimes Act of 1996, a federal statute set forth at <a href="http://caselaw.lp.findlaw.com/scripts/ts_search.pl?title=18&amp;sec=2441">18  U.S.C. § 2441</a>, makes it a federal crime for any U.S. national, whether military or civilian, to violate the Geneva Convention by engaging in murder, torture, or inhuman treatment. The statute applies not only to those who carry out the acts, but also to those who <a href="http://www.democracynow.org/article.pl?sid=05/06/30/1333214#transcript">ORDER  IT, know about it, or fail to take steps to stop it.</a> The statute  applies to <a href="http://www.nlg.org/news/statements/BushTortureJune2004.htm">everyone,  no matter how high and mighty</a>.  Indeed, even the <strong>lawyers</strong> and other people who aided in the effort <a href="http://www.sfgate.com/cgi-bin/article.cgi?f=/c/a/2005/11/13/INGUPFLGKJ1.DTL">may  be war criminals</a>; see also  <a href="http://www.fpif.org/fpiftxt/3026"> this article</a>, <a href="http://harpers.org/archive/2008/02/hbc-90002346">this one</a>, and  <a href="http://nlg.org/news/index.php?entry=entry080409-083133">this  press release</a></p>
<p>.</p>
<p>The detainees were obviously subjected to mutilation, cruel treatment, torture, and humiliating and  degrading treatment, and so both the Convention and the War Crimes Act were violated.</p>
<p><span style="text-decoration: underline;">The Bigger Picture</span></p>
<p>But it is important to keep the medical experimentation story in context.</p>
<p>The bigger picture is that torture doesn&#8217;t work, it reduces our national security, and it is mainly used to extract false confessions and as a form of intimidation to squash dissent.</p>

<p><span style="font-family: Verdana,Arial; font-size: x-small;"><strong>42 Arrested at U.S. Capitol in Day of Action to Denounce Obama’s Broken Promises on Guantanamo, America’s Broken Laws, and the Breaking of Lives by Torture</strong></span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Washington, DC: In a dramatic protest, 42 activists with Witness Against Torture were arrested this afternoon at the U.S. Capitol. Most of the arrestees had been fasting since January 11th.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">The protest, which comes on the eve of the since-voided deadline President Obama had set for closing the prison camp at Guantanamo, was part of nationwide set of actions today that included dozens of Iraq and Afghanistan veterans lobbying Congress; a campaign by human rights organizations &#8211; with the support of the rock superband, Coldplay &#8211; to flood Twitter with the &#8220;CloseGitmo&#8221; message; and, a press conference held by retired Generals at the National Press Club.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Those arrested on the Capitol steps held banners reading &#8220;Broken Promises, Broken Laws, Broken Lives.&#8221; Inside the Capitol, 14 activists performed a &#8220;memorial service&#8221; for the three men whose deaths at Guantanamo in 2006 were initially reported as suicides and callously described as &#8220;acts of asymmetrical warfare&#8221; by military officials. New reports provide strong evidence that the men may have been tortured to death at a CIA secret prison in Guantanamo.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">The ceremony brought the names of the men&#8211; Salah Ahmed Al-Salami, Mani Shaman Al-Utaybi and Yasser Talal Al-Zahrani&#8211; into the Capitol Rotunda, where deceased presidents have lay in state. &#8220;We perform this ceremony to recognize the humanity of those whose lives have been broken by our government’s policies of torture and indefinite detention,&#8221; says Jerica Arents of Chicago, Illinois, one of those arrested in the Capitol.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Witness Against Torture has called for an immediate, independent investigation of the deaths, as it has called for the criminal investigation of all those who allegedly designed, executed, and carried out torture policies.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Most of the 42 arrested at the Capitol did not carry identification, taking instead the names of men at Guantanamo through arrest and processing. &#8220;Taking the name of Adnan Farhan Abdul Latif is a necessary and real way of bringing his story to Congress,&#8221; says Joshua Brollier, a co-coordinator with Voices for Creative Nonviolence in Chicago, Illinois. &#8220;Adnan was tortured and continues to be held after eight years without charge or trial. It boggles the mind and breaks the heart. It’s time for Congress and the Obama administration to make and fulfill a plan for his release.&#8221; Brollier and others from Voices will continue in Washington through February 2, participating in the Peaceable Assembly Campaign to pressure Obama administration and Congress to explore alternatives to U.S. militarism. </span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">The actions at the Capitol followed a march of &#8220;Guantanamo prisoners&#8221; dressed in orange jumpsuits and black hoods that began at the White House and stopped at the Supreme Court before going to Capitol grounds, home to the U.S. Congress. &#8220;Congress has played a horrible role in refusing to check the power of the president and in supporting torture,&#8221; commented Matt Daloisio of New York City, a Witness Against Torture organizer. &#8220;But it was important to pass by all of the government institutions that have failed to uphold justice and protect the rule of law.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Members of Witness Against Torture began a Fast for Justice on Monday, January 11&#8211; the date in 2002 when the first men were brought to Guantanamo under the Bush administration’s &#8220;war on terror.&#8221; One-hundred fifty people from around the country joined the 12 day fast, which will end on Friday, January 22, the promised day for Guantanamo’s closure.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">&#8220;We were so hopeful last year,&#8221; says Christine Gaunt, a grandmother and third generation farmer from Grinnell, Iowa, who was arrested at the Capitol. &#8220;But Obama has broken his promise to close Guantanamo. I am acting today because I am horrified and ashamed that this illegal prison continues to exist, and that those responsible for torture have not been held to account. I am using my body to demand that my government stop the insanity of torture and illegal detention.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Witness Against Torture is a grassroots movement that came into being in December 2005 when 24 activists walked through Cuba to the Guantanamo base to condemn the prison camp and torture policies. Since then, it has engaged in public education, community outreach, and non-violent direct action.</span></p>

<p><span style="font-family: Verdana,Arial; font-size: x-small;"><img title="Mohamed Saleban Bare" src="http://www.andyworthington.co.uk/wp-content/uploads/mohamedbare.jpg" alt="Mohamed Saleban Bare" width="199" height="256" />AFP <a onclick="pageTracker._trackPageview('/outgoing/www.google.com/hostednews/afp/article/ALeqM5iRDDKxWMoO8EtwpdcH99Z_tSEVAQ?referer=http://www.andyworthington.co.uk/');" href="http://www.google.com/hostednews/afp/article/ALeqM5iRDDKxWMoO8EtwpdcH99Z_tSEVAQ" target="_self">secured an interview</a> on Monday with Mohamed Saleban Bare (known to the Pentagon as Mohammed Sulaymon Barre), the Somali refugee, <a href="http://www.andyworthington.co.uk/2009/12/21/the-stories-of-the-two-somalis-freed-from-guantanamo/" target="_self">released from Guantánamo</a> at the weekend with eleven other men (including another Somali, Ismail Mahmoud Muhammad), who ran a money transfer operation for the Somali diaspora in Karachi, Pakistan, until he was seized in a house raid on November 1, 2001. The organization he worked for was, in the eyes of the US authorities, involved with another money transfer company that had ties to the 9/11 hijackers, even though the 9/11 Commission concluded over five years that this was not the case.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Speaking to AFP reporter Mustafa Haji Abdinur in a hotel in Bare’s home town of Hargeisa, the capital of the northern breakaway state of Somaliland, Bare declared, &#8220;Guantánamo Bay is like hell on Earth.&#8221; He added, &#8220;I don’t feel normal yet but I thank Allah for keeping me alive and free from the physical and mental sufferings of some of my friends. Some of my colleagues in the prison lost their sight, some lost their limbs and others ended up mentally disturbed. I’m OK compared to them.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Bare told Abdinur that he was &#8220;in good physical health,&#8221; but the reporter explained that the 44-year old &#8220;looks dazed, speaks very softly and walks gingerly.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">After explaining that, at the time he was seized, he had been in Pakistan for many years &#8220;with several relatives who had fled the violence in Somalia and were hoping to find asylum in a western state,&#8221; he stated that he was held in Pakistan for about four months, and then transferred to US custody in Afghanistan.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">&#8220;At Bagram and Kandahar, the situation was harsh but when we were transferred to Guantánamo the torture tactics changed,&#8221; he explained. &#8220;They use a kind of psychological torture that kills you mentally.&#8221; This, he added, &#8220;included depriving prisoners of sleep for at least four nights in a row and feeding them once a day with only a biscuit.&#8221; He also explained, &#8220;And in the cold they let you sleep without a blanket. Some of the inmates face harsher torture, including with electricity and beating.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">Abdinur noted that Bare was &#8220;reluctant to answer questions about his alleged ties with Al-Ittihad Al-Islamiya, a Somali Islamist movement which produced many of the current leaders of the Al Qaeda-linked Shebab,&#8221; which was, I think, understandable given that he had finally been released after eight years’ detention without charge or trial by the US authorities, who would not have done so had there been any evidence of such an involvement.</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">In response to the questioning, he stated instead, &#8220;Guantánamo is a place of humiliation for Muslims. All the inmates are Muslims but they (Americans) claim the prison is for terrorists. Why don’t they arrest non-Muslims belonging to these so-called terror groups?&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">He also stated, &#8220;No human rights convention stands in Guantánamo. Interrogators force inmates to confess crimes they didn’t commit by torturing them and sullying their religion. They would throw Korans into the toilet and raise the volume of their music during prayers.&#8221;</span></p>
<p><span style="font-family: Verdana,Arial; font-size: x-small;">In conclusion, he explained that the US authorities had &#8220;never told him why he was arrested,&#8221; stating, &#8220;They used to ask many questions, most of them relating to my background like what I was doing in Somalia and about the people I know. It was all about suspicions and not a clear case.&#8221;</span></p>

<p>Reports that <a title="More from guardian.co.uk on CIA" href="http://www.guardian.co.uk/world/cia">CIA</a> agents may be helping their Palestinian security counterparts to <a title="More from guardian.co.uk on Torture" href="http://www.guardian.co.uk/world/torture">torture</a> prisoners (<a title="Special report" href="http://www.guardian.co.uk/world/2009/dec/17/cia-palestinian-security-agents">Special report</a>, 18 December) are bad enough. What is more of a concern to me, though, is that Palestinians, for so long holding the moral ground in the struggle for justice in the Holy Land, could actually torture their fellow Palestinians; this concern applies equally whether the alleged torturers belong to Fatah or Hamas. Even more worrying is that Said Abu-Ali, the Palestinian Authority&#8217;s interior minister, has sought to excuse what is happening because such abuses &#8220;happen in every country in the world&#8221;. So that makes it OK, then. Astonishing. And he&#8217;s a minister in the government regarded as the &#8220;moderates&#8221; by the US, Europe and Britain.</p>

<p>• That <a title="the CIA" href="http://www.cia.gov/">the CIA</a> has been supporting torturers in the Palestinian security forces should come as no surprise. The CIA has a long history of training foreign security forces in torture techniques, even though they were forbidden in the US itself (until Bush and Cheney decided it was time to remove the kid gloves). The CIA helped train the Shah of Iran&#8217;s notorious Savak secret police, the Pakistani secret services and a whole list of paramilitary forces in Central America.</p>
<p>During its war against the Sandinistas in Nicaragua, its infamous training manual, demonstrating the use of torture techniques, became public and caused widespread outrage. If Obama wishes to retain any humanitarian credibility, he should clean up the CIA and outlaw all torture techniques and their export.</p>

<p>Where affluent Lithuanians once rode show horses and sipped coffee at a café, the CIA installed a concrete structure where it could use harsh tactics to interrogate up to eight suspected <a href="http://abcnews.go.com/Blotter/story?id=6607572&amp;page=1" target="external">al-Qaeda</a> terrorists at a time.</p>
<p>&#8220;The activities in that prison were illegal,&#8221; said human rights researcher John Sifton. &#8220;They included various forms of torture, including sleep deprivation, forced standing, painful stress positions.&#8221;</p>
<p>Lithuanian officials provided ABC News with the documents of what they called a CIA front company, Elite, LLC, which purchased the property and built the &#8220;black site&#8221; in 2004.</p>

<p>The Obama administration wants to maintain the secrecy of terrorist watch list information it routinely shares with federal, state and local agencies, a move that rights groups say would make it difficult for people who have been improperly included on such lists to challenge the government.</p>
<p>Intelligence officials in the administration are pressing for legislation that would exempt &#8220;terrorist identity information&#8221; from disclosure under the Freedom of Information Act.<span> </span></p>
<p>Such information &#8212; which includes names, fingerprints and other biometric identifiers &#8212; is widely shared with law enforcement agencies and intelligence &#8220;fusion centers,&#8221; which combine state and federal counter-terrorism resources.</p>
<p>Some officials say public disclosure of watch-list data risks alerting terrorism suspects that they are being tracked.<span> </span></p>
<p>Advocates for civil liberties and open government argue that the administration has not proved the secrecy is necessary and that the proposed changes could make the government less accountable for errors on watch lists.<span><br />
